Interpretation

In these Conditions:

​

  • “Buyer” means the person who accepts to purchase from the Seller for the sale of the Goods.

  • “Goods” means the goods which the Seller is to supply in accordance with these Conditions and any goods supplied in replacement of or in addition to said goods.

  • “Seller” means FOAK Luxury Kitchenware.

  • “Conditions” means the standard terms and conditions of sale set out in this document and (unless the context otherwise requires) includes any specific terms and conditions agreed in writing between the Buyer and the Seller.

  • “Contract” means the contract for the purchase and sale of the Goods.
    “Writing” includes letter, online communication, emails comparable means of communication.

Contract

  • By completing a transaction with the Seller, the Buyer is stating that they have read this Terms & Conditions document and agreed to the information written.

  • We will ensure that all applicable information is clearly outlined throughout the purchase, regarding but not limited by, design, returns, delivery, taxes and craftsmanship.

  • Once the Buyer has received the order confirmation when purchasing goods, they are agreeing to the contract outlined here and must abide by the guidelines given.

  • The Buyer, on purchase of the Sellers Goods, is agreeing to use the Goods bought for the purposes intended. All the Sellers knives are for food preparation and eating only.

Specification of goods

  • The seller ensures with every product that the information given is truthful and detailed. All illustration, photographs and descriptions are correct at time of posting, some imperfections may arise on postage and photographs may obscure products.

  • Goods may have variations agreed between the Buyer and Seller, this must be detailed in writing.

  • All information and direction from the Buyer must be clearly outlined during purchase to the seller, all information provided and personalisation must be full and correct. Any errors on the Buyers part will be responsibility of the Buyer.

  • The Seller may make alterations to the specification created by the Buyer, in best interest of the product.

Price and payments

  • The price given on the Sellers products online is the fixed price. The price will be stated on order confirmation. Any discounts given will be applied via a coupon and stated in the order confirmation.

  • The prices stated by the Seller before purchase by the Buyer are subject to change.

  • Delivery costs are not included in the price, this will be paid in addition to the stated product price. The price will be added before purchase and included in the order confirmation.

  • All payments must be completed before Goods can be delivered. Invoice will be sent on receipt of payment.

  • Payments will be accepted through: Paypal, Stripe, Klarna and bank transfer.

Sales

  • When purchasing Seller knives, you are confirming that you are over the age of 18. This is the law when purchasing knives of a certain length in the UK.

  • Made to order sales can be refunded within 3 days, after this period the sale is final and the product will not be refunded.

  • Made-to-order products will have a lead time dictated and clearly stated by the Seller on order confirmation.

Delivery

  • The Seller will accept order from the United Kingdom and Europe. Outside of this area, it will be up to the Sellers discretion and will be permitted to reject an order. Any payments will be refunded.

  • Collections from the Sellers premises will need to be arranged via appointment.

  • All products delivered fall under UK postage laws.

  • It is down to the Seller to ensure that Goods are delivered safely, any circumstance out of the Sellers control which means the Goods are damaged or not received will be discussed between the Buyer and Seller and a resolution must be made in Writing.

  • The Seller will not send Goods until the Buyer has paid in full.

  • On delivery conformation, the Sellers guarantee and returns period will begin.

External events

  • The Seller is not responsible for late recipient of an order due to external events. For example, failure of a supplier to provide materials. 

  • The Seller will make it known to the Buyer that an event outside of the Sellers control has happened and when the event will be resolved.

  • If the Seller cannot fulfil an order due to an external event, this will be discussed by the Buyer and Seller, the resolution will be given to the Buyer, by the Seller in writing.

  • If an external event continues for more than 30 days with resolution, the Buyer will be permitted to cancel the order and receive a full refund.

  • If an external event on the Buyers side arises, before delivery confirmation, the Buyer must make it known to the Seller immediately. The Seller will then provide a statement in Writing, outlining the decision to cancel the order or fulfil the order.

  • After delivery confirmation, the Buyer will not be permitted to cancellation due to external events.

Contact, complaints and feedback

  • The Seller can be contacted before order confirmation via the following means: phone, email, post and social media.

  • After order confirmation, the Seller asks the Buyer to make all correspondents in Writing, via email or post.

  • The Seller will strive to always fulfil the needs of the Buyer. If the Buyer has a complaint, it must be made in Writing via email or post. This will be dealt with by the Seller quickly and clearly. Resolution will be made in writing and all complaints acknowledged.

  • The seller appreciates all feedback. This can be made via the Sellers social media, post and email.

Data Protection

  • All personal information that we may collect (including, but not limited to, your name and address) will be collected, used and held in accordance with the provisions of the Data Protection Act 1998 and your rights under that Act.
